Prairie Brand warrants that seed sold by it conforms to the label description
on the seed packaging within tolerances established or permitted by law. PRAIRIE BRAND MAKES NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHICH ARE HEREBY DISCLAIMED. It is expressly agreed that Prairie Brand’s liability for any loss or damage arising out of or relating to the purchase or use of its products, including but not limited to liability arising out of breach of contract, breach of warranty or negligence, shall be limited, at the sole discretion of seller, to comparable product or to the amount of the purchase price for the seed. This remedy is exclusive. In no event shall Prairie Brand be liable for any incidental or consequential damages, including loss of profits.
Prairie Brand utilizes isolation and purity measures in the production of its seed products. Because of factors beyond its control, Prairie Brand does not represent or warrant that any Prairie Brand products are free of any genetically modified materials or organisms.
These terms and conditions of sale are in addition to those contained in Prairie Brand sale documents (e.g., order forms) and on Prairie Brand product packaging and labeling.
Seed products with the LibertyLink® (LL) trait are resistant to the herbicide glufosinate ammonium, an alternative to glyphosate in corn, and combine high-yielding genetics with the powerful, non-selective, postemergent weed control of Liberty® herbicide for optimum yield and excellent weed control.
Avicta Complete Corn 250 and Avicta Complete Corn 500 are Restricted Use Pesticides. For use by certified applicators only. Growers planting Avicta treated seed are not required to be certified applicators. Avicta technology is protected by U.S. Patent No. 6,875,727. Seeds containing the Roundup Ready® trait and the Roundup Ready 2 Yield® trait are protected under numerous U.S. patents. Seed containing patented traits, such as seed containing the Roundup Ready and Roundup Ready 2 Yield traits, can only be used to plant a single commercial crop. It is unlawful to save and replant Roundup Ready soybeans and Roundup Ready 2 Yield soybeans.
